Sponsor eligibility
Sponsor (benefactor, petitioner) could be any person legally present in United States but have to satisfy few requirements:
- Be lawfully present resident or an U.S. person.
- Sponsor should show a sufficient income level and assets to support the beneficiary. We published a simple calculator here to help you figure this out.
- There could be multiple sponsors per beneficiary, all of which should satisfy above requirements
- Sponsor must provide a statement from bank showing the transactions and balance.
- Sponsor must provide their employment statement and a federal tax income transcript.
- Sponsor must provide evidence for assets that they would use to cover beneficiary's financial needs.
Income requirements for sponsors:
- Sponsor must meet 100% of the Federal Poverty Guidelines income level for sponsor's household.
- If sponsor has a shortfall of the income level for the household, they are encouraged to list assets that will cover that shortfall.
- USCIS has published in past indicating that the shortfall should be at least covered by five times in net value of assets.
Sponsors are highly encouraged
- Be honest in I-134 and when communicating to any government representative
- Be able to welcome beneficiary in the USA, i.e. meet them in airport and offer a ride to their housing
- Help complete paperwork for SSN, employment, medical where appropriate
- Offer advice about USA and help with transition where possible
Sponsors are not required
- NOT required to govern entire process
- NOT required to host at their home or provide some free-of-cost
- NOT required and not encouraged to add beneficiaries on credit cards, accounts or take other financial risks to support beneficiary
- I-134 is not enforceable and sponsors cannot be sued for financial assistance
Filing I-134
To start the process you need to create an account on My USCIS and file the form. Click link below to go to official USCIS website and file the form.
USCIS instructions for filing (PDF)- Make sure you have contact with the beneficiary as you will need to enter some of their information.
- Any mistakes on the form will be hard to change, especially name, email and passport related information.
- A separate form should be sumbitted for each beneficiary.
- If you falsify or conceal a material fact from USCIS, form will be denied and you might be object to a cruiminal prosecution.
Results

After you send the form, you will see a receipt in your My USCIS account.2
Next step is to wait until USCIS officer reviews and approves the form.3
When form is reviewed, you will receive a separate email notification to check your My USCIS account, which will have a confirmation letter posted in your notices.4
This signals that beneficiary will receive an invitation to their email and could start filling out their information.
